If you entered Australia without a valid visa or were not immigration cleared on arrival, you may only be eligible to apply for a Temporary Protection visa (TPV) or a Safe Haven Enterprise visa (SHEV). You cannot apply for a permanent Protection visa (subclass 866).

Family

Safe Haven Enterprise visa (subclass 790)
This visa is for people who arrived in Australia without a visa and want to seek asylum. It lets you stay in Australia temporarily for 5 years, work and study and access government services such as Centrelink, if you engage Australia’s protection obligations and meet all other requirements for the grant of the visa.

Temporary Protection visa (subclass 785)
This visa is for people who arrived in Australia without a visa and want to seek asylum. It lets you stay in Australia temporarily for 3 years, work and study and access government services such as Centrelink, if you engage Australia’s protection obligations and meet all other requirements for the grant of the visa.

Protection visa (subclass 866)
This visa is for people who arrived in Australia on a valid visa and want to seek asylum. It lets you stay in Australia permanently and sponsor eligible family members for permanent residence through Australia’s offshore humanitarian program.
