Unfortunately, negative outcomes of visa application are a reality that many people have to deal with. In such a stressful situation, you may still have options to request a review of the decision or appeal the decision to the AAT or Federal Circuit Courts. The application for review or appeal is time-sensitive and it’s crucial that you have sound and practical advice from experienced immigration lawyers like ourselves to follow the correct process and ensure your best chance of a favourable outcome.
The Department of Home Affairs may cancel a visa for several reasons, for example:
- The visa holder did not comply with the visa conditions;
- The visa holder did not satisfy the character requirements; or
- The visa holder provided false information on the visa application.
In such situations, the Department of Home Affairs usually notify you of its intention to consider cancelling your visa and give you the opportunity to provide reasons why your visa should not be cancelled. If the Department cancels your visa, it may also cancel visas held by your family members.
If the Department refuses or cancels your visa, you may be able to request a review of the visa refusal or visa cancellation decision. We can assist you to lodge a request for review with the AAT or appeal to the Federal Circuit Court.
